NHS England has published updated enforcement guidance following a statutory consultation. The guidance details how NHS England will use its enforcement powers over NHS providers and Integrated Care Boards (ICBs). The updated guidance includes changes implemented by the Health and Care Act 2022, including the dissolution of NHS Improvement and the formation of ICBs. The types of enforcement action and the appeals process remain unchanged. Trusts may see some differences as the guidance now formally applies to them, and ICBs will experience the highest level of change.
