UnitedHealth, OptumRx sued by independent pharmacy over ‘unconscionable’ fees

UnitedHealth and its pharmacy benefit manager OptumRx are being sued by an independent pharmacy for allegedly forcing them into accepting unreasonable performance-based fees. Osterhaus Pharmacy in Iowa claims the contracts, including direct remuneration fees, could make them dispense prescriptions at a loss. The pharmacy is seeking class action status to include thousands of independent pharmacies with similar OptumRx contracts. Osterhaus alleges that OptumRx set metrics for the fees and forced them on pharmacies who must pay to remain in its Medicare Part D network.
