The FCC Expands Scope of Data Breach Notification Rules

In late 2023, the FCC issued an Order expanding data breach notification rules for telecommunications and VoIP providers. The Order broadens the definitions of a “breach” and “covered data” and now requires these entities to notify the FCC of breaches. Changes are due to take effect in 2024. Entities must notify customers “without unreasonable delay”, no more than 30 days after determination of a breach, eliminating the previous seven-day waiting period.
