New FTC Rule Requires Digital Health Companies To Notify Users of Data Breaches

The Federal Trade Commission (FTC) has updated its Health Breach Notification Rule, increasing scrutiny and potential penalties for digital health firms like BetterHelp and Calmerry. The new rule applies to unauthorized disclosure of personally identifiable health data and even includes wellness apps previously not considered healthcare providers. Most digital health companies are not covered by the Health Insurance Portability and Accountability Act’s (HIPAA) privacy rules. The rule takes effect 60 days post-publication in the Federal Register.
