Data Breaches: Compliance Obligations Under The Nigerian Data Protection Act 2023 – Data Protection

Data breaches have increased by 64% in Nigeria’s digital economy, a rise driven by a population of over 200 million people. The Nigerian Data Protection Act (NDPA) 2023 governs breaches and outlines steps organisations must take if they suffer one. In the event of a breach, data controllers must notify affected data subjects immediately and notify the Nigeria Data Protection Commission (NDPC) within 72 hours. Non-compliance with NDPA’s obligations can lead to fines, criminal prosecution of senior officers, and reputational damage.
