Breach Notification Challenges in Healthcare Law

Michigan Attorney General, Dana Nessel, is pushing for changes in Michigan’s data breach notification law to require healthcare providers to notify the Attorney General in the event of a breach of health information under HIPAA. Currently, the law only requires notification of affected individuals and the federal Office of Civil Rights. The update seeks to provide more vigilant handling of data breaches, especially those involving identity crimes and data risks faced by individuals due to breaches caused by vendors.
