Court Grants Defendant’s Motion to Extend Data Breach Case

The Memorial Heart Institute’s (MHI) motion to dismiss a data breach case has been partially granted and partially denied by a U.S. District Court. The case, involving a cyber attack that compromised the personal and health information of roughly 411,000 individuals, included allegations that MHI failed to provide adequate protection of sensitive data. While the court dismissed several claims, it acknowledged the merits of MHI’s negligence and breach of contract claims.
