Law professor Dan Solove argues that consent in privacy law is mostly fictitious and both US and EU regulations fail. Solove says privacy law should introduce a new “murky consent” approach accepting the fictitious nature of privacy consent and boosting regulatory oversight. He suggests four duties: obtaining consent appropriately; avoiding thwarting reasonable expectations; loyalty and avoiding unreasonable risk.
